Terms of Service

1) Who we are

These Terms of Service (“Terms”) govern your use of the website, forms, and services provided by [Legal Name of Brokerage/Agent], operating as Larisa Belikova (“we,” “us,” “our”). We are a licensed insurance intermediary in Canada. Our contact details: [address] · [email] · [phone].

By using our site or submitting a quote request, you agree to these Terms and to our Privacy Policy.

2) Scope of services (Broker, not insurer)

We act for you as your broker to obtain quotes, place coverage, help with renewals and changes, and support you during claims. We do not underwrite insurance or set premiums. Insurance is provided by third-party insurers and is always subject to their underwriting and policy wording.

3) No coverage until confirmed

Online quote requests and indications are not binding offers of insurance. Coverage starts only when:

  • the insurer accepts your application and issues a policy or binding confirmation, and
  • all conditions (including required payments) are satisfied.
    We will confirm your effective date in writing (e.g., email, policy documents).

4) Your responsibilities

You agree to:

  • provide true, complete, and current information when requesting quotes or buying coverage;
  • promptly tell us about changes that may affect your policy (address, drivers, business operations, renovations, etc.);
  • review all documents we send (applications, summaries, policies) and report any errors within a reasonable time;
  • pay premiums and any applicable service fees by the due date.

Misrepresentation or omission may lead to higher premiums, cancellation, or a denied claim.

5) Quotes & pricing

Quotes are estimates based on information you provide and insurer rules at that time. Premiums, eligibility, and discounts may change after underwriting, inspections, or new information.

6) Compensation disclosure

We are typically compensated by insurers through broker commissions and may receive additional contingent compensation. On request, we will disclose how we are paid for your policy.

7) Payments, refunds & NSF

You authorize us or the insurer/finance company to charge your selected payment method for premiums, fees, and taxes. Late/returned payments may incur charges or cancellation per the insurer’s rules. Refunds (if any) follow the policy’s terms and any earned premium.

8) Electronic communications & e-signatures

You consent to receive documents electronically (email, secure portal, SMS) and to use electronic signatures. Paper copies are available on request. Keep your contact details up to date.

9) Marketing consent (CASL)

By submitting your contact information, you consent to receive emails/SMS about your policies and optional marketing from us, compliant with Canada’s Anti-Spam Legislation (CASL). You can withdraw consent anytime (e.g., reply STOP to SMS or use email unsubscribe).

10) Privacy

We collect, use, and disclose personal information to quote, place, and service insurance, in accordance with PIPEDA and applicable provincial privacy laws (e.g., PIPA AB/BC, PHIPA ON for health information). See our Privacy Policy for details on what we collect, how we safeguard it, and your choices.

11) Claims support

We will guide you through first notice of loss and liaise with the insurer/adjuster as appropriate. The insurer makes all final coverage and settlement decisions under your policy.

12) Third-party sites & tools

Our site may link to third-party websites or use third-party tools (payment gateways, portals). We are not responsible for their content, availability, or security. Use them at your own risk and review their terms and policies.

13) Intellectual property & acceptable use

All site content (text, graphics, logos) is our or our licensors’ property. You may not copy, modify, scrape, or use the site in a way that disrupts services or violates law. You may download materials we provide for your personal or internal business use only.

14) Geographic restrictions

Our services are intended for residents of [list provinces/territories where licensed]. Availability of products varies by insurer and province/territory.

15) Disclaimers

To the fullest extent permitted by law, the website is provided “as is” without warranties of uninterrupted or error-free operation. Information on the site is general and not personalized financial, tax, or legal advice. Final terms of any insurance are only those in the insurer’s policy documents.

16) Liability limit

To the extent permitted by law, our total liability for claims arising from the site or services will not exceed the greater of (a) CAD $1,000 or (b) the commissions we received for the policy giving rise to the claim. We are not liable for indirect, incidental, or consequential damages. This does not limit liability that cannot be excluded under applicable law.

17) Indemnity

You agree to indemnify and hold us harmless from losses, costs, and claims arising from your misuse of the site or from information you supplied that was inaccurate or incomplete.

18) Changes to Terms

We may update these Terms at any time. Changes take effect when posted with the “Last updated” date above. Continued use of the site means you accept the revised Terms.

19) Suspension/termination

We may suspend or terminate access to the site or decline service where permitted by law (e.g., suspected misuse, non-payment, regulatory reasons).

20) Complaints & dispute resolution

If you have a concern, contact us first at [complaints email/phone]. If not resolved, you may have access to provincial regulators and industry ombudservices, such as the OmbudService for Life & Health Insurance (OLHI) or the General Insurance OmbudService (GIO), depending on your product and province. We will provide the appropriate escalation path upon request.

21) Governing law

These Terms are governed by the laws of the Province of [Province] and the federal laws of Canada applicable therein. Venue and jurisdiction lie with the courts of [City/Province].
